1. About us
This website, axivonuk.com, is operated by KS Holdings PTY LTD, trading as Axivon (“we”, “us”, “our”).
Email: support@axivonuk.com
2. Eligibility
You must be 18 or over to place an order, or have the consent of a parent or guardian. You agree to give us accurate and complete information when ordering.
3. Products and descriptions
We take care to show our products, colours and descriptions accurately. Colours may look different depending on your screen, and images are for illustration, so the product you receive may vary slightly in appearance. This doesn’t affect your right to receive goods that match their description.
4. Health and safety
Our products are wellness devices designed for comfort and relaxation. They are not medical devices and are not intended to diagnose, treat, cure or prevent any medical condition. Please consult a doctor before use if you are pregnant, have a pacemaker or other implanted device, have recently had surgery, or have a medical condition. Always follow the instructions supplied with the product.
5. Prices and payment
All prices are in pounds sterling (GBP) and include VAT. Shipping costs are calculated at checkout. We may change our prices at any time, but you’ll pay the price shown when you placed your order. If a product is listed at an obviously incorrect price, we may cancel the order and give you a full refund. Payment is taken in full at checkout, and we process your order once payment is confirmed.
6. Orders and acceptance
When you place an order, you’re making an offer to buy. A contract is formed when we email you to confirm we’ve accepted your order. We may decline or cancel an order, for example if an item is out of stock, there’s a pricing error or we suspect fraud. If we cancel an order you’ve paid for, we’ll refund you in full.
7. Delivery
Delivery times and costs are set out in our Shipping Policy. Your order is our responsibility until it’s delivered to the address you gave us.
8. Your right to cancel
Under the Consumer Contracts Regulations 2013, you can cancel your order for any reason within 14 days of the day you receive it. To cancel, email support@axivonuk.com. You then have a further 14 days to return the goods. We’ll refund you, including standard delivery costs, within 14 days of receiving the goods back or of you showing proof that you’ve returned them. We may reduce the refund if the goods have been handled more than necessary to check them.
9. Faulty goods and your legal rights
Under the Consumer Rights Act 2015, goods must be as described, of satisfactory quality and fit for purpose. If they’re faulty, you may be entitled to a refund, repair or replacement. Our 30-day guarantee, set out in our Refund Policy, is in addition to these rights. Nothing in these terms affects your statutory rights.
10. Use of the website
You must not:
- use this website unlawfully or fraudulently;
- try to gain unauthorised access to it;
- interfere with how it works, or introduce harmful code;
- copy or exploit its content without our permission.
We may suspend access if these terms are breached.
11. Intellectual property
All content on this website, including text, images, logos and design, belongs to us or is licensed to us. You may not use, copy or distribute it without our written permission.
12. Privacy
We handle your personal data in line with the UK GDPR and the Data Protection Act 2018. Our Privacy Policy explains how.
13. Our liability
If we break these terms, we’re responsible for loss or damage you suffer that is a foreseeable result. We aren’t responsible for loss that isn’t foreseeable, or for business losses. We don’t exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, and for breach of your rights under the Consumer Rights Act 2015.
14. Third-party links
Our website may contain links to other websites. We aren’t responsible for their content or practices.
15. Changes to these terms
We may update these terms from time to time. Changes will be posted on this page with a new date. The terms that apply to your order are the ones in force when you placed it.
16. Governing law
These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
